Mobile Terms and Conditions

These Text Messaging Program Terms & Conditions (“Texting Terms”) apply to your participation in any text messaging programs (each a “Program”) provided by iFIT, NordicTrack, or ProForm, (each a “Company”). Your participation in a Company’s Program constitutes your express consent to receive automated text messages (e.g., SMS messages and MMS messages) from that Company at the mobile number you provided, including text messages that may be sent using an automatic telephone dialing system or sent at any time of the day. By signing up for a Company’s Program, you agree to these Texting Terms and the Terms of Use, into which these Texting Terms are incorporated by reference. If you do not agree to these Texting Terms or the Terms of Use (including the DISPUTE RESOLUTION; BINDING ARBITRATION terms contained in those Terms of Use), you must immediately discontinue your participation in all Programs by following the below cancellation instructions.

Program Details

A Company’s Program may include recurring and nonrecurring text messages related to promotions, products, events, cart reminders, special offers, or other Company-related news, as well as other information that the Company thinks will be of interest to you. The delivery time of text messages varies by Program. For example, if you use the AI Coach, you may receive non-marketing text messages at any time of the day, such as a reply to a text message you send to the AI Coach at any hour or when you schedule the AI Coach to send you a text message at a certain time.

Message frequency will vary. Each Company reserves the right to alter the frequency of messages sent at any time, so as to increase or decrease the total number of sent messages. Each Company also reserves the right to change the short code or phone number from which messages are sent. Consent to receive automated text messages is not a condition of any purchase. Message and data rates may apply.

Each Company’s Programs are offered on an “as is” basis. They may not be available in all areas at all times and may not work in the event of a coverage or other service change by your mobile carrier. A Company’s Program may not support all mobile devices or handsets, and messages may not be deliverable in all areas.

Each Company, its service providers, and the mobile carriers supported by a Company’s Program are not liable for delayed or undelivered messages.

Each Company may discontinue or change its Programs at any time without notice.

Supported Mobile Carriers

The content of a Company’s messages may not be available and viewable on all mobile carriers. Standard Message and Data Rates May Apply. Each Company reserves the right to add or remove eligible mobile carriers from its Program at any time.

In the U.S., each Company is able to deliver messages to certain carriers, including, without limitation, the following: AT&T, T-Mobile®, Verizon Wireless, and Boost Mobile.

In Canada, each Company is able to deliver messages to certain carriers, including, without limitation, the following: Bell, Fido, MTS, NorthernTel, Rogers, SaskTel, Telebec, Telus, Videotron, Eastlink, Aliant, Public Mobile, Mobilicity Virgin Mobile, Wind.

In Australia, each Company is able to deliver messages to certain carriers, including, without limitation, the following: AT&T, Sprint, T-Mobile, Verizon Wireless, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, ACS Wireless, Appalachian Wireless, Bluegrass Cellular, Carolina West Wireless, Cellcom, C-Spire Wireless (formerly Cellsouth), Cellular One of East Central Illinois, Cincinnati Bell Wireless, Cross (dba Sprocket), Duet IP, Element Mobile, EpicTouch, GCI Communications, Golden State, Hawkeye (Chat Mobility), Hawkeye (NW Missouri Cellular), Illinois Valley Cellular, Immix (Keystone Wireless / PC Management), Inland Cellular, iWireless, Mobi PCS (Coral Wireless LLC), Mosaic, MTPCS / Cellular One (Cellone Nation), Nex-Tech Wireless, nTelos, Panhandle Telecommunications, Peoples Wireless, Pioneer, Plateau, Revol Wireless, Rina - Custer, Rina - All West, Rina - Cambridge Telecom Coop, Rina - Eagle Valley Comm, Rina - Farmers Mutual Telephone Co, Rina - Nucla Nutria Telephone Co, Rina - Silver Star, Rina - South Central Comm, Rina - Syringa, Rina - UBET, Rina - Manti, South Canaan / CellularOne of NEPA, Thumb Cellular, Union Wireless, United, Viaero Wireless, West Central Wireless, Leaco, Nemont/Sagebrush.

Cancellation

You may opt out of a Company’s Program at any time. Text the keyword STOP, CANCEL, QUIT, END, or UNSUBSCRIBE to the phone number or short code that messaged you to cancel your participation in that Company’s Program. After texting STOP, CANCEL, QUIT, END, or UNSUBSCRIBE to the phone number or short code that messaged you, you will receive one additional message confirming that your request has been processed. Opting out of receiving text messages from one Company does not opt you out from receiving text messages from any other Company. For each Company that sends you text messages, you must individually opt out from receiving text messages from that Company.

We strive to honor all opt-out requests, but we may not be able to recognize and honor requests that do not consist of the STOP, CANCEL, QUIT, END, or UNSUBSCRIBE keyword commands. In that case, you agree that each Company and its service providers will have no liability for failing to honor such requests.

Help and Consumer Care

Text the keyword HELP to the phone number or short code that messaged you to receive consumer care contact information. If you are experiencing any problems, please contact each Company as described in the Contact section.

If you have any questions about your text plan or data plan, it is best to contact your mobile carrier directly.

French Language

This Agreement is a contract used in relations with persons outside Quebec. The parties expressly agree to contract in the English language.
